“Go Massif SARL” (herein known as "the Company", “we”, “us”, ourselves, “it’s” and “our”). All web generated bookings with Go Massif are governed by the following terms and conditions.
Definitions:
"You", "your" and "yourself" refers to the person who has a confirmed booking for travel with go massif (see definition of passenger and party leader).
“Agreed destination” The place that the passenger or party leader has agreed with Go Massif is the final stopping point on any particular journey.
"Agreed Stopping Places" means any agreed places, except the starting point of a journey and the agreed destination, where the vehicle may stop en-route.
“Pick up point” means the address, or place shown on the booking conformation that Go Massif has agreed to meet the passenger/s.
“Pick up time” The time, stated on your booking confirmation, you are due to meet our representative and be ready to start any agreed journey.
"Baggage" means all luggage and personal property accompanying you whilst taking a journey with Go Massif.
“Booking Confirmation” means the email, which constitutes evidence of confirmation of payment and agreement for travel made by you with us for a journey, or number of journeys.
“Booking Reference” means the reference, using a combination of numbers and letters, that you are given by us to identify your booking.
“Carriage” Means the act of us taking one or more passengers form one agreed place to another.
“Children” mean persons less than sixteen years of age.
“Damage” means any harm, accidental or intentional, that reduces the value of belongings or property.
"Days" means calendar days, including all seven days of the week.
“Destination” agreed place where a journey ends.
“Fragile Items” means items that are likely to break or malfunction if transported without specialised protection or handling.
“Group” means more than one person.
“Itinerary” means the total collective of your agreed journey/s.
“Journey" means a single trip from an agreed pick up point to an agreed destination as stated in the booking confirmation.
“Multiple persons” means a group or more than one person.
“Partner Company” means other companies’ whose services we may, from time to time, recommend to you.
“Party leader” means the person responsible for the booking and all passengers within a specific group booking.
"Passenger" means any person, except the driver, carried in a vehicle with our consent.
“Price” means the amount to be paid.
“Sub-Contractors” means any agent appointed by the company to carry out duties on behalf of the company.
“Surcharges” means charges incurred by us that will be passed on to paying passengers.
“Vehicle” means the minibus, bus, coach or car that is provided by us for passengers to take their journey, or journeys, in.
"Our Website or ‘the Website’" means the internet site www.gomassif.com provided by us for the purpose of giving information to potentially interested parties.
1.0 APPLICABILITY
Conditions and definitions found in this document refer to, and govern all bookings confirmed by email that you make with Go Massif SARL.
These terms and conditions are governed by FRENCH LAW. Any dispute that is not resolved through mutual agreement shall be referred to the French courts.
1.1 Contracted Persons
Any person with a confirmed booking shall be known as the Party Leader. The Party Leader enters into a contract with Go Massif when he/she is in receipt of a booking conformation and receipt of payment from Go Massif.
When bookings for groups are received the person making the booking will be treated as the Party Leader (the Party Leader might not necessarily be travelling with the party).
All correspondence and communication for anyone in the party will be directed to the Party Leader. The Party Leader guarantees that he or she has the authority to accept, and does accept, these terms and conditions on behalf of the whole party. This includes accepting any communications or correspondence from us on behalf of all passengers/members of your party.
You must be 16 years or older to be the Party leader.
1.2 Copyrights
All copyrights, database rights, design rights, and all intellectual property rights belong to Go Massif. All text and graphics, their arrangement, and all mark up/layout/scripts, software compilations, underlying source (hyper text mark up language and scripts) and all other materials on our website belong solely and absolutely to Go Massif.
No part of our website can be reproduced, except for purposes of referencing and printing out booking confirmations, in any form whatsoever, electronically or otherwise, without our prior consent in writing.
1.3 Liability Disclaimer
We disclaim and exclude any duty of care which we may owe you in respect of the information on this web site. Your reliance on this web site and your use of this web site is entirely at your own risk. Nothing on this web site constitutes an offer to enter into any contract, and all booking requests and offers of payment by you are subject to acceptance by Go Massif.
We do not exclude our liability for fraudulent misrepresentation.
This web site contains hyper links to web sites operated by third parties. If you activate this hyper link you will leave the Go Massif website. We have no control over, and will not accept any liability in respect of the material in any website you access through a hyper link from our website.
Vehicles are fully insured for passenger and third party claims, as required under French law. Passengers property is carried entirely at the passengers own risk and no responsibility can be accepted for loss or damage. Customers are therefore advised to obtain travel insurance to cover any costs of replacing or repairing any damaged or lost items.
We shall have no liability for any delay or failure to carry you, or for breach of contract, if caused by a circumstance beyond our control. The following shall be considered to be circumstances beyond our control:
a) Accidents causing delays to the vehicle you are scheduled to travel in, or accidents causing delays to the vehicle you are travelling in.
b) Delays or Cancellations due to severe weather conditions and other natural occurring phenomena such as floods, fallen trees, fires, rock-falls and avalanches.
c) Vehicles being detained or delayed by a police officer, customs official or other government official.
d) Deaths and accidents on the road, including delays due to us assisting other people who are involved in road traffic accidents.
e) Vandalism and terrorism.
f) Industrial action by third parties.
g) Illness or malady to passengers or driver, or other circumstances affecting passenger or driver safety.
h) Riots, civil unrest, hostile conflict, war or threat of war.
i) Vehicle breakdown or malfunction.
Except in the case of negligence, or omission done with intent to mislead, we shall not be liable for errors or omissions as to the price, pick up location, dates or times of pick up for any journey.
If we are found to be in breach of contract our liability is limited only to passengers travelling in our care. Our liability for loss shall not exceed €200 Euro per passenger.
1.4 Privacy Statement
Your personal data has been given to us for the purposes of making a booking and providing you with confirmation of that booking; administrative, accounting and legal purposes; systems testing, statistical analysis and helping us in any future dealings with you. For these purposes you authorise us to retain and use your personal data and to transmit it to our authorised agents, government agencies, sub-contractors and/or partner companies.
1.5 Security
Payment transactions are carried out between your credit card provider and our bank's secure sever. Your credit card details are not accessed or retained by us and cannot be viewed by others accessing the Go Massif website.
Due to the inherent open nature of the internet Go Massif cannot guarantee that communications between you and us will be free from unauthorised access by other third parties such as internet hackers. Your use of our website demonstrates your acceptance of this risk.
1.6 Amendments and Waivers
None of our drivers, representatives, sub-contractors or partner companies has authority to alter, modify or waive any of these terms and conditions.
2.0 Our Obligation to You
It is our obligation to provide you with the agreed number of seats to transport you and your party, at the agreed times, on the journeys stated on your booking confirmation. The routes we choose to use shall be the one’s deemed most appropriate according to traffic and road conditions (including road works), weather conditions, welfare of passengers and their safety. At all times will shall make reasonable efforts to carry you with the minimum discomfort and inconvenience.
3.0 Prices
All prices (unless stated) are inclusive of TVA (value added tax) charged at 5.5%)
All prices and products on are not an offer by us but an invitation for you to make an offer to us. You make this offer when you click the “I agree to gomassif terms and conditions” during the booking process. We reserve the right to accept or reject any such offers.
3.1 Changes to Quoted Price
Prices that appear on the Go Massif website and prices quoted by email are subject to change without notice until full payment is made and booking confirmation has been made.
If there are any price changes necessary after the booking has been made, Go Massif will produce written confirmation of any theses changes in the form of an email to the Party Leader.
Price changes can occur as a result of adding necessary surcharges to your booking. These surcharges may only be added due to the following circumstances that are out of our control:
a) Increased labour costs
b) Introduction of new taxes to the passenger transport industry
c) Increases in the cost of transport licences.
d) Increases in airport parking fees
e) Increases in fuel costs
f) Increases in prices charged by sub-contractors
g) Increase in road taxes or road tolls
You will be notified of any changes in price due to surcharges, and in all cases you have the right to cancel your booking and receive a refund as set out in condition 8.1 (cancellations by you).
3.4 Currency
Prices are quoted in Euros. Payments received by the company shall be in Euros. On credit card transactions we are not responsible for charges levied or costs incurred through currency exchanges made by your credit card provider. The price in Euros remains fixed on each quotation.
4.0 Payment
All payments to be made in full using Master Card or Visa at time of booking.
5.0 Prima Facie Evidence of Contract
When you have paid you will receive an email with confirmation of payment. This email combined with your booking confirmation email from us will form the necessary evidence of a contract for travel with us. Your booking confirmation must have a booking reference number on it that corresponds to the booking reference number on your confirmation of payment.
If you do not receive written confirmation by email following your payment then your booking is considered invalid.
Journeys are scheduled only when we have a fully paid reservation, and when confirmation of payment by email has been made from Go Massif to the party leader
5.1 Requests for Quotations or Questions Relating to Availability
Any responses Go Massif make to requests for quotations or questions regarding availability are not contractually binding.
6.0 Validity
A booking is only valid for the journey or journeys stated on that particular booking. Unless 14 days notice is given, bookings are not transferable from one person to another or from one date or time to another.
7.0 Changes to your Booking
Changes must be made via email in writing. Changes can only be made by Go Massif and the Party Leader. Any agreement made verbally between individual passengers and drivers must be confirmed in writing between the Party Leader and Go Massif.
7.1 Changes to your Booking made by you
Changes to bookings may be made by you up to 14 days before the first date of travel. If you wish to change your booking you must inform us within 14 days before the date of your first journey that has been booked with us.
7.2 Changes to your booking made by us
At any time after a booking has been made we may bring forward proposed pick up times. Bookings may be, terminated, diverted, postponed or delayed where we reasonably consider this to be justified by circumstances beyond our control or for reasons of safety (see condition 1.3).
In the event of a diversion along the route we will arrange for you to be carried to the agreed destination using the safest route available or the route as directed by government or road management officials.
In the event of postponement, delay or disruption, we shall arrange for you to being carried to the agreed destination as soon as possible, taking the safety of all passengers and the driver into consideration.
In the event of any terminations, diversions, postponements, delays or any other changes to a booking, we shall not be liable for any expense incurred to any passengers. These expenses include costs of nourishment, lodging and onward transport.
Where any alteration is made to a booking before the date of your journey, we shall contact the Party Leader by email or by phone. It is the responsibility of the Party Leader to inform all passengers on the booking confirmation of any changes. Where changes occur less than 48 hours prior to your first journey with us we shall telephone you.
8.0 Cancellations
Cancellations can only be made by Go Massif and the Party Leader.
8.1 Cancellations by You
You may cancel your booking at any time. In all cases we will retain 20% of the price of the booking.
If you cancel more than 14 days before your first journey on your booking confirmation you shall be entitled to a refund of 80% of the price paid for your booking.
If you cancel less than 14 days prior to your first journey on the booking confirmation no refund is permitted.
Anyone detained or delayed by customs officials, the police or other government official on route shall be deemed to have terminated their journey and therefore have cancelled their booking. No refund shall be permitted in such circumstances.
8.2 Cancellations by Us
The company reserves the right to cancel a booking if circumstances beyond its control make it impossible to fulfil the booking. Written or verbal confirmation of the cancellation will be provided. The customer is entitled to a full refund of any monies paid in this case.
9.0 Pick up Points
Passengers must be available at the agreed pick up point at the agreed time.
9.1 Pick ups at Airports
If your confirmed pick up point is at an airport our representative will be waiting to meet you in the airport arrivals hall. He/She will have a notice with the name of the party leader on it. If, for any reason, you are unable to meet our representative within 30 minutes of your scheduled flight arrival time you must telephone us using the contact number on your booking confirmation. Our representative will only be available to wait for you for 90 minutes after your scheduled flight arrival time.
9.1.1 Waiting Time at airports for passengers arriving on scheduled flights
If you require our vehicle and driver to wait for more than 90 minutes after your scheduled flight arrival time we will impose a waiting charge. This charge will be 5 Euros for each 10 minutes that the driver and vehicle is required to wait after the initial 90 minute waiting period has elapsed. Waiting charges must be paid in Euros to the driver or representative before you get on the vehicle.
9.1.2 Consequence of not making contact with us or our representative
If you fail to meet, or contact, our driver or representative we shall assume you have cancelled your booking with us in accordance with Condition 8.1.
9.1.3 Persons in private cars or rental vehicles
We are only responsible for passengers travelling in our vehicles. Our drivers are not permitted to wait for, assist, or guide other persons who may wish to follow our vehicles to your agreed destination.
9.2 Pick ups at all other locations
At all other pick up locations you and your party must be ready at the agreed time. You must be waiting outside the main entrance of the building of the agreed pick up address with all baggage appropriately packed ready for loading. The driver and vehicle will leave within 15 minutes of the agreed pick up time. The driver and vehicle will not wait for any passengers who are not in the vehicle within 15 minutes of the agreed pick up time.
If you are not at the agreed pick up location at the agreed pick up time, we shall assume you have cancelled your booking in accordance with Condition 8.1.
9.2.1 Waiting time for pick up at locations other than airports
If the driver and vehicle are requested to wait longer than 15 minutes after the agreed pick up time a waiting charge will apply. This will be 5 Euros for each 10 minutes period that the driver and vehicle is required to wait after the initial 15 minute period has elapsed.
9.3 Vehicle Seating Arrangements
We guarantee to provide the agreed number of seats for the specified number of passengers in your group. We reserve the right to seat other passengers in the same vehicle.
9.4 Stops en-route
Any stops en-route must be pre-arranged and be clearly stated on the booking confirmation. Our drivers are not permitted to make any un-scheduled stops en-route.
10 Baggage Allowance
Each passenger on the booking confirmation is entitled to take the following pieces of baggage on our vehicles:
1small bag (max size 50cm long, 30 cm wide, 20 cm deep)
1 large bag (suitcase, rucksack or other type of large bag) (max size 120cm long, 70 cm wide, 40 cm deep)
(Prams, strollers and baby buggies will be transported free of charge. They must be of the fold down variety.)
10.1 Specialised Sports Equipment
Any items of sports equipment such as skis, snowboards, golf clubs and bicycles must be detailed on your booking confirmation. Each passenger is permitted to one item each. We reserve the right to refuse carriage of any item of sports equipment that has not been specified on your booking confirmation.
All sports equipment must be appropriately packed in a bag specifically designed for that particular type of sports equipment.
(Total weight of combined luggage including sports equipment must not exceed 40kg).
10.2 Excess Baggage
Where passengers exceed the limits of baggage as specified in Condition 10 and 10.1, this shall be deemed excess baggage. We have no obligation to put excess baggage onto our vehicles. In circumstances where passengers are in possession of excess baggage, any attempts to put it on the vehicle shall be at the complete discretion of the driver. Excess baggage will only be loaded if space is available, weight limits are not exceeded, and the safety of the vehicle and passengers is not compromised.
10.3 Late Baggage
Your bags must be available for loading at the agreed pick up time. We are not responsible for waiting for bags.
10.4. Unacceptable Baggage and Fragile Items
You must not include in your Baggage:
a) Items which are likely to endanger yourself, fellow passengers, the driver or anyone coming into contact with our vehicles or customers.
b) Items which are prohibited by the applicable laws, regulations or orders of any country your agreed itinerary is scheduled to take you to or through
c) Illegal drugs, firearms, explosives, fireworks, flammable liquids
d) Human remains will not be accepted for carriage. However, the carriage of human ashes in a suitable container is permitted.
e) Items that give off offensive odours.
f) Animals
We reserve the right to refuse to accept baggage for carriage unless properly packed in suitcases or other suitable containers to ensure safe carriage. We will not accept responsibility for any fragile items.
10.5 Baggage Searches
For reasons of safety and security, we may require you to authorise and consent to a search of your baggage. This will be done if we suspect you are in possession of any items listed in Condition 10.4. If consent is not given we reserve the right to refuse to carry your baggage.
10.5 Loading of baggage
It is the responsibility of the driver to load all baggage presented to him by the passengers. We cannot be held responsible for any bags not presented at the time of loading. It is the responsibility of the passengers to ensure all his/her baggage has been presented to the driver.
10.6 Personal Effects
It is the responsibility of the passenger to ensure he collects all personal belongings upon completion of the journey. We are not responsible for misplaced, left or lost items.
10.7. Unloading of Baggage
It is the responsibility of the Party Leader to ensure unloaded baggage is distributed to appropriate passengers. You shall collect your baggage as soon as it is available for collection from the driver at your drop off destination. If you do not collect your baggage or personal effects we may dispose of them without any liability to you.
10.8 Left Luggage, Lost items and Damage
Any items that are left on vehicles are left entirely at the owners own risk. We have no responsibility or liability for any items left on vehicles. Where requests are made for these items to be delivered back to their owners, these requests shall be dealt with separately. We are not a baggage delivery company and therefore delivery of left baggage is not part of the agreement to which these to these terms and conditions apply.
We have no liability for lost or damaged baggage. We accept no responsibility for items lost or damaged in transit. You are advised to insure your baggage against loss, delay or damage. Please check the terms and conditions of your travel insurance policy.
11. Customs Checks
Where a vehicle is required to stop at any immigration, passport or customs check-point, the vehicle will wait for up to 30 minutes to enable all normal checks to be carried out. However, the vehicle will not be obliged to wait for any passenger who, along with their baggage, is delayed for more than 30 minutes. If any passenger is delayed or detained we have no responsibility for them. Any passenger delayed or detained shall be deemed to have terminated their contract with us (see condition 8.1)
Where your luggage is removed from a vehicle for customs checks, you will be responsible for reclaiming, re-packing and returning your bags from those checks, ready to be reloaded onto the vehicle.
12. Children
We will not be obliged to carry any person less than 16 years of age unless that person is accompanied by a responsible person aged 18 or over.
12.1 Child seats law
You must tell us at the time of booking if you wish us to provide any child seats. You must state which category of seat you require. All children under the height of 1.35meters must be seated in an appropriate seat. If you have not told us which category of seat your child requires we cannot guarantee them carriage with us.
13. Passenger Behaviour Rules
Please note the following rules of expected/proper passenger behaviour. If you feel that you or any of your party will be unable to abide by these rules please do not book to travel with us:
Customers are expected to behave in a respectful, sensible and lawful manner towards our drivers, representatives and sub-contractors.
Mobile phones should be used considerately with the comfort of other passengers in mind.
You shall not be abusive or threatening to anyone, or conduct yourself in a manner way which may endanger yourself or others.
You must not or behave in a manner which causes discomfort, inconvenience, damage or injury to other persons.
You must not play any radios, cassette or CD players, personal stereos, musical instruments or radio or electronic devices that are audible and distracting or annoying to any person.
You must not take any alcoholic drinks to consume on the journey.
You must not take any illegal drugs on our vehicles.
You must not take any hot food on to our vehicles
You must not smoke on our vehicles
You must not board our vehicles whilst under the influence of alcoholic drinks or illegal drugs
You must not board our vehicles whilst you are seriously ill or suffering from any contagious illness.
You must not leave rubbish, spill liquid or soil our vehicles in way.
13.1 Consequences of Improper Behaviour:
If you fail to comply with any of the rules of behaviour listed in Condition 13, or we have reason to believe you may continue any conduct that is in breach of these behaviour rules, we shall be entitled to prohibit you from travelling with us.
If you are in breach of any of the rules in Condition 13 we shall assume that you have terminated your contract with us according to condition 8.1 (cancellations by you). You and you baggage shall be refused carriage.
Any failure to comply with requests to leave a vehicle will result in us contacting the nearest police official and reporting your behaviour to them.
The party leader shall be responsible for paying a 50 Euro cleaning fee (payable on demand to the driver) should anyone in their party dispose of litter, spill liquid or soil a vehicle in any way.
Any person who physically mistreats, or attempts to physically mistreat any of our representatives, drivers or sub-contractors will be reported directly to the police.
Any damage caused to our vehicles by a customer must be paid for immediately. If payment cannot, or will not, be made then we will pursue legal action against the Party Leader in order to obtain payment for damage.
13.2 Our Liability for the Behaviour of Passengers to one another
We cannot be held liable for the actions of any passenger towards any other passenger/s.
